TripScout (“we” or “us”) provide this Privacy Statement to inform you about our policies and procedures regarding the collection, use and disclosure of information through www.tripscout.co (the “Site”), our mobile application, and any other websites, features, applications, widgets or online services that are owned or controlled by us (collectively, the “Services”). Your privacy is important to us. By using the Services, you agree to the data collection, use, disclosure and storage practices described in this Privacy Statement. This Privacy Statement also explains how we may use and disclose such information, as well as your ability to control certain uses of it. When you interact with us through the Services, we may collect information from you, as further described below. We collect information about you in a range of forms, including personal information, when you choose to provide it to us. Personal information (or personal data) means information about an individual from which that person can be identified. It does not include personal information where the identity has been removed (anonymous personal information). This may include when you make travel plans and reservations, contact us with inquiries or otherwise contact us.

We are committed to protecting your personal information and your right to privacy. Please read this privacy policy carefully as it will help you make informed decisions about sharing your personal information with us.

By accessing or using the Services, you consent to the information collection, disclosure and use practices described in this Privacy Statement. Please note that certain features or services referenced in this Privacy Statement may not be offered on the Services at all times. Information You Provide to Us

We collect information from you when you choose to provide it to us. This may include when you create an account with us, sign up for our email lists, use our Services, make travel plans and reservations, submit a rating or review, participate in a survey or promotion, or otherwise contact us.

If you have created an account, you may be able to voluntarily provide additional information in various areas of the Services. For example, you may want to provide additional information as part of an optional profile to enhance your experience and use its features. We may use this information to personalize the Services and their features just for you.



Your User Submitted Materials are posted on and transmitted to others at your own risk. Although you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.



Personal Information: While using the Services, we may collect information that identifies you as a specific individual and can be used to contact or identify you (“Personal Information”). Examples of Personal Information we may collect include your name, address, email address, telephone number, mobile telephone number, geolocation information, photos or videos, user name, travel booking information (including reservation dates, travel destination and hotel and other accommodation and trip information) purchase history, credit/debit card number or other financial information and billing address. We may also collect additional types of personal information that you choose to provide to us. This could include information about yourself or others that you are authorized to provide to us, including information about children that is provided in connection with utilizing our travel-related services. Our mobile application may request access to the photographs stored on your mobile device; if you choose to allow that access some of the photographs may be personally identifiable. You may be required to provide certain authentication and credential information to create your account, including a username and password.

Payment Information: If you use the Services to make purchases, we will also collect certain payment information, such as payment card, PayPal, Square, or other financial account information, and billing address. A third-party payment processor collects that information; we do not store your credit card information.

Non-Identifying Information: We also may collect other information, such as zip codes, and other information regarding your use of the Services (“Non-Identifying Information”) or from you in response to surveys. Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers in a way that enables you to be identified (for example, combining information with your name). We may combine your Personal Information with Non-Identifying Information, but we will treat the combined information as Personal Information.

Information Collected From Other Sources

We may obtain information about you from other sources, including social media platforms like Facebook or Instagram that you use to connect with Us. If you use a third party service to login, link to us, or communicate with us (such as a social network or third party video chat), we may receive certain information about you from the third party based on your registration and privacy settings on those third party services. This information may include name, user name, demographic information, location information, updated address or contact information, interests, and publicly-observed data, such as from social media and online activity.

Information Obtained from Third Parties

If others give us your information, we will only use that information for the specific reason for which it was provided to us. For example, if you have agreed to share information with one of our travel partners, we may add this information to the information we already hold about you.

We may use the information we collect from and about you to:

  • present the Services and its contents to you;
  • process your registration with the Services, including verifying the information that you provide to us;
  • provide you with services or information or fulfill transactions that you have requested or otherwise agreed to receive;
  • send you marketing communications, newsletters, special offers from us, our advertisers, or third-party business partners or other third-parties that we believe may be of interest to you, and to tailor content we display to you, including offers we present to you through the Services;
  • provide customer service to you, including, without limitation, to respond to your questions, complaints or comments, request feedback, fulfill orders, process payments and prevent transactional fraud, and contact and communicate with you;
  • facilitate and assist with travel reservations and other travel-related services and plans;
  • improve the content and functionality of our Services and for internal business purposes and marketing efforts;

    INFORMATION SHARING AND DISCLOSURE

    We may share and disclosure the personal information we collect from and about you, or you provide to us, as described in this privacy statement

  • With third parties to facilitate your travel plans and reservations, including technology platforms used to make travel and trip-related bookings, travel suppliers and hotels/accommodations providers.

  • With third parties that we believe may provide promotional materials, and goods and services that may be of interest to you.

    We may disclose Personal Information about you to selected business partners or other third parties who we believe may be of interest to you, and they may send you marketing offers or similar information directly. If you want to opt-out of such sharing with third parties for marketing purposes, you may notify us at privacy@tripscout.co. If you later decide that you no longer want to receive communications from a third party, you will need to contact that third party directly. You also may request, sometimes through your use of a social media service or similar interactive feature or third party application, that we share information about you with a third party and we will typically do so under those circumstances.

    • Our affiliates and subsidiaries;
    • Service Providers or other third parties we use to support our business, to enable them to perform a business, professional or technical support function for us;
    • as necessary if we believe that there has been a violation of this Privacy Statement, our Terms of Use, of our rights or the rights of any third party;
    • to fulfill the purpose for which you provide it;
    • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
    • to respond to judicial process or provide information to law enforcement or regulatory agencies or in connection with an investigation on matters related to public safety, national security or law enforcement, as permitted by law, or otherwise as required by law;
    • with your consent; and
    • as described to you at the point of collection.

    If we are involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Services of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information

    We may sell or purchase assets during the normal course of our business. If another entity acquires us or any of our assets, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should such a sale or transfer occur, we will use reasonable efforts to try to require that the transferee use personal information provided through the Services in a manner that is consistent with this Privacy Statement.

    We also may share aggregate or anonymous non-personal information with third parties for their marketing or analytics uses. We do not sell your personal information to third parties.

    INFORMATION WE AUTOMATICALLY COLLECT AND COOKIE POLICY

    As is true of most web sites, we automatically gather information about your computer such as your IP address, browser type, referring/exit pages, and operating system.

  • We may use cookies, web beacons, pixel tags, log files, or other technologies to automatically collect certain information when you use our Services or interact with our emails and online or mobile advertisements. For example, we may automatically collect certain non-personal information from you such as your mobile device identifier or MAC address, browser type, operating system, device model, software version, Internet Protocol (“IP”) address, mobile or ISP carrier information, and the domain name from which you accessed the Services. We also may collect information about your use of the Services including the date and time you access the Services, the areas or pages of the Services that you visit, the amount of time you spend using the Services, the number of times you return, whether you open forward or click-through emails and ads, and other usage data so that we can understand the statistical use trends of our website in order to make improvements. The information we collect automatically does include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to estimate our audience size and usage patterns, store information about your preferences, allowing us to customize our Services according to your individual interests, speed up your searches and recognize you when you return to our Services.

    We may also use third-party tools or services to assist us with analyzing and improving the Services. These third parties are not permitted to use the information collected on our behalf except to help use conduct and improve our business.

    We capture the following information:

    Usage Details. When you access and use the Services, we may automatically collect certain details of your access to and use of the App, traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App.

    • Domain Name – through which you access the Internet

    • IP address – from the computer or network used to access our Services

    • Web browser – and operating system used

    • Date and time – you accessed our Services

    • Pages, files, documents, and links – that you visited

    • Referral Internet address – of the website from which you clicked to get to our Services

    Search terms – used in a search engine (like google.com) that brought you to our Services.

    Device Information. We may collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, web browser type, mobile network information, and the device's telephone number.

    Stored Information and Files. The Services also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.

    Location Information. The Services collect real-time information about the location of your device.

    If you do not want us to collect this information do not download the App or please delete it from your device. Continue below for choices about how we use and disclose your information. Note, however, that opting out of the App's collection of location information will disable its location-based features

    We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking). Continue reading for information on how you can opt out of behavioral tracking on or through the Services and how we respond to browser signals and other mechanisms that enable consumers to exercise choice about behavioral tracking. We may also use third-party tools or services, including from our service providers, to assist us with analyzing and improving the Services.     Tracking Options and California Do Not Track Disclosures. We strive to provide you with choices regarding the personal information you provide to us.

    You may adjust your browser or operating system settings to limit this tracking or to decline cookies, but by doing so, you may not be able to use certain features on the Services or take full advantage of all of our offerings. If you block the use of location information, some parts of the App may become inaccessible or not function properly.

    • Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by sending us an email with your request to privacy@tripscout.co. You can also always opt-out by logging into the Services and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email privacy@tripscout.co.

    • Promotional Offers from the Us. If you do not wish to have your email address used by us to promote our own or third parties' products or services, you can opt-out by checking the relevant box located on the form on which we collect your data you can click on the unsubscribe link on emails you received from us or email us at privacy@tripscout.co or at any other time by logging into the Services and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to privacy@tripscout.co. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions.

    • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by emailing us at privacy@tripscout.co. For this opt-out to function, you must have your browser set to accept all browser cookies.

    Combination of Information

    We may combine the information we receive from and about you, including information you provide to us and information we automatically collect through our Services as well as information collected offline or from third party sources to help us tailor our communications to you and to improve our Services.

    We do not sell your personal information to third parties.

    THIRD PARTIES

    We may contract with third parties to perform functions related to the Services (“Service Providers”). Service Providers will have access to your personal information needed to perform their business functions, but may not use or share that personal information for other purposes. These companies are authorized to use your personal information only as necessary to provide these services to us.

    PUBLIC FORUMS

    Any information you may disclose in ratings or review, on message boards, in chat rooms or on other public areas of the Services, becomes public information and may be subject to the terms of use of other Services or platforms. Please exercise caution when disclosing personal information in these public areas.

    You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Services, or transmitted to other users of the Services or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

    LINKS TO OTHER WEB SERVICES

    This Privacy Statement applies only to the Services. The Services may have links to third-party Services or applications, including payment processors, social media or video platforms which may have privacy policies that differ from our own. We are not responsible for the practices of such Services or applications. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit Personal Information from you. We encourage you to read the privacy policies or statements of the other websites you visit.

    CHILDREN'S PRIVACY

    Protecting children’s privacy is important to us. We do not direct the Services to, nor do we knowingly collect any personal information from, children under the age of 16. In connection with your use of the Services, you may choose to provide information to us about the ages of children who are included in your travel booking or trip-related service, but not any personally identifiable information about any children under age 16.

    DATA SECURITY

    We have taken certain physical, administrative, and technical steps to safeguard the information we collect from and about our customers and Services visitors and users. While we make every effort to help ensure the integrity and security of our network and systems, we cannot guarantee our security measures. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

    Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

    DATA STORAGE AND RETENTION

    Your personal information is stored on servers in the United States. You understand and agree that TripScout may collect, use, disclose, and otherwise process the information you provide as described in this Privacy Statement even if you are from an area outside the United States. Your personal information may be disclosed in response to inquiries or requests from government authorities or to respond to judicial process in the United States. We will retain your personal information for as long as it is needed to provide you with the Services, or to fulfill any legal or contractual obligations we may have.

    If you are a resident of the EEA or UK: Your personal information will be transferred to and processed in the United States, which has data protection laws that are different than those in your country and may not be as protective.     ACCESS TO YOUR PERSONAL INFORMATION

    If you have an account on our Services, you may sign in to your account and update your personal information contained in the account. You may also send us an email at privacy@tripscout.co to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. California, EEA and UK residents may have additional personal information rights and choices.     This Privacy Notice for California Residents applies solely to all visitors, users, and others who reside in the State of California (”consumers” or “you”).     Use of Personal Information

    We may use or disclose the personal information we collect as set forth in this Privacy Statement, including for one or more of the following purposes:

    • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to request a price quote or ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information to book a trip, we will use and disclosure that information to third parties process your payment and facilitate your reservation or other trip-related service. We may also save your information to facilitate new product orders or process returns.

    • To provide, support, personalize, and develop our Services, products, and services.

    • To create, maintain, customize, and secure your account with us.

    • To process your requests, purchases, transactions, and payments and prevent transactional fraud.

    • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.

    • To personalize your Services experience and to deliver content and product and service offerings relevant to your interests, including targeted offers, promotions, discounts, incentives and ads through our Services, third-party sites, and via email or text message (with your consent, where required by law).

    • To help maintain the safety, security, and integrity of our Services, products and services, databases and other technology assets, and business.

    • For testing, research, analysis, and product development, including to develop and improve our Services, products, and services.

    • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

    • As described to you when collecting your personal information or as otherwise set forth in the CCPA.

    • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our Service users is among the assets transferred.

    We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you with notice.

    Sharing and Disclosing Personal Information

    We may disclose your personal information as set forth in this Privacy Statement, including to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. We share your personal information with Service Providers and with third party advertisers, analytics, and content providers. We do not sell personal information.

    In the preceding twelve (12) months, we have not disclosed personal information for a business purpose/has disclosed the following categories of personal information for a business purpose:

    Right to Know and Data Portability

    You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability and Deletion Rights), we will disclose to you:

    • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

    • Debug products to identify and repair errors that impair existing intended functionality.
